The petitioner seeks regular bail in Laheri P.S. Case No.138 of 2017 for the offence under Sections 413, 414/34 of I.P.C.
Allegation as per the F.I.R. is that during course of checking police intercepted one motor cycle and demanded paper of the vehicle upon which co-accused Sanjiv Kumar replied that he had no paper of the vehicle as he had purchased the said bike from his friend, Jagdeo Yadav who happens to be the petitioner of this case.
Submission of the learned counsel for the Petitioner is that his name has come in confessional statement of co-accused.
Patna High Court Cr.Misc. No.39008 of 2017 (2) dt.21-08-2017 2/2 There is no specific allegation against the petitioner and he is in custody for four months. It is stated that the petitioner is involved in three cases and he is on bail in one case. Two other cases have been lodged after subsequent lodging of the present case. It has also been submitted that even no recovery has been made from the possession of the petitioner and stolen article has not been recovered from the possession of the petitioner.. Heard learned Special A.P.P. also who opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as state above, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Incharge C.J.M., Biharsharif, in Laheri P.S.Case No.138 of 2017 subject to the conditions that one of the bailors should be local person having sufficient immovable properties within the jurisdiction of the court and they will cooperate in the trial and appear before the court on each and every date fixed in the case, failing which his bail bond will be cancelled.
