The petitioner seeks anticipatory bail in connection with Ahiyapur, P.S. Case No. 54 of 2018, registered for offences punishable under Sections 406, 420 and 120-B of the Indian Penal Code.

As per F.I.R., allegation against the petitioner is that he introducing himself to be agent of City Finance Service to the informant and asked the informant that if he will deposit Rs.3,00,000/- in the said Company, he would get Rs.6,00,000/- in lieu thereof and, thereafter, the informant deposited Rs.3,00,000/ through cheque in the said company but he did not receive any amount.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and petitioner was neither the agent of the company nor anyways

Patna High Court Cr.Misc. No.43357 of 2018(3) dt.24-07-2018 2/2 connected with the said City Finance Service. It is further submitted that nothing was entrusted by the petitioner to the informant and nothing material has been found against the petitioner.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Ahiyapur, P.S. Case No. 54 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
