JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 12-10-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 201, 354-A/34 of the Indian Penal Code. The accusation is of killing the niece of the informant for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and she has falsely been implicated in this case. The petitioner is mother-inlaw of the deceased and she had no concern with the day-do-day affairs of the deceased and her husband. The
Patna High Court CR. MISC. No.60983 of 2023(3) dt.12-10-2023 2/2 specific allegation of mounting pressure for physical relation with the deceased or of assaulting and strangulating her to death has been exclusive and specifically levelled against the brother-in-law namely Chandsi Patel. The petitioner lives separately from the husband of the deceased. The petitioner is languishing in custody since 25.04.2023.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Bettiah, West Champaran in connection with Gaunaha P.S.
