In this case, the petitioners are seeking regular bail in connection with Kurhani P.S. Case No.99 of 2016, registered for the offence punishable under Sections 272, 273 and 290 of the Indian Penal Code, under Section 47(A) of the Excise Act and under Section 47 of the Excise Amendment Act, 2016. Allegation has been made against the petitioners that they were involved in trading of illegal liquor and the petitioner No.1 was keeping the liquor in the house of his sister. The police raided the house of the sister of the petitioner No.1 on 01.04.2016 and from there recovery of liquor was made.

Patna High Court Cr.Misc. No.27078 of 2016 (2) dt.14-07-2016 2/2 The provisions of Excise Amendment Act, 2016 for foreign liquor have been notified on 05.04.2016. In the present case, the raid was conducted by the police on 01.04.2016 at 11:30 in the morning and the liquor, which was recovered, was foreign liquor.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10, 000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Kurhani P.S. Case No.99 of 2016.
