This application for anticipatory bail arises out of Barauli P.S. Case N0. 286 of 2018, disclosing offences under Sections 147,149,323,307,504 of the Indian Penal Code. For an occurrence said to have taken place on 17.11.2018, case and counter case have been registered. The counter case has been registered as Barauli P.S. Case No. 287 of 2018 in which the informant of the present case and the persons, who are said to have sustained injuries have been implicated. Both the cases have been filed five days after the alleged date of occurrence.

Learned counsel for the petitioners has submitted that land

Patna High Court CR. MISC. No.51491 of 2019(2) dt.19-08-2019 2/2 dispute is the reason behind lodging of the First Information Report and no grievous injury has been sustained by any one. In paragraph 3 of the application, it has been stated that the petitioners are accused in a complaint case registered in 1994.

Considering the facts and circumstances and the submissions made on behalf of the petitioners as noted above, this application is allowed.

Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Barauli P.S. Case No. 286 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themsleves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
