2. In this case, the petitioner is seeking regular bail in connection with Sugauli P.S. Case No. 158 of 2024, registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 504 and 506/34 of the Indian Penal Code.
3. The specific allegation against the petitioner is that he assaulted Bhulan Sah on his head with sharp-edged weapon.
4. The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. He has further submitted that there is case and counter case between the parties. He has also submitted that though it is true that there is allegation against the petitioner is that he assaulted Bhulan Sah on his head, but the nature of injury has not been mentioned in the order of the learned court below. The petitioner is a person of clean
Patna High Court CR. MISC. No.59602 of 2024(2) dt.28-08-2024 2/2 antecedent and is under custody since 15.06.2024.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari East Champaran in connection with Sugauli P.S. Case No. 158 of 2024, subject to the condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
