The petitioner has renewed his prayer for bail which was earlier rejected vide order dated 09.02.2023 passed in Cr. Misc. No. 60392 of 2022.

It is alleged against the petitioner that he shot fire at the brother of the informant as a result of which, he sustained gunshot injuries on his stomach and died. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is counter version of

Patna High Court CR. MISC. No.56645 of 2023(3) dt.13-10-2023 2/3 the occurrence also and petitioner's side also sustained injuries. The petitioner is languishing in custody since 01.02.2021.

In contra, learned counsel appearing on behalf of the informant and learned A.P.P for the State have vehemently opposed the prayer for bail of the petitioner and submitted that specific allegation of shot fire to the brother of the informant is against the petitioner which resulted into his death. The postmortem report and the independent witnesses have also supported the case of the prosecution.

In pursuance to the direction of this Court, a report with regard to the present stage of the trial has been received which has been kept at Flag-R.

The report of learned I/C Additional District & Sessions Judge-III, Jamui dated 01.09.2023 suggests that case is pending for appearance of accused and framing of charge and the trial is likely to be concluded within nine months.

No.56645 of 2023(3) dt.13-10-2023 3/3 Considering the fact that there is specific allegation against the petitioner, this Court is not inclined to take a different view in the matter. The prayer for grant of bail to the petitioner stands rejected. The Trial Court is directed to expedite the trial and conclude the same within a period of six months from today.

The petitioner will be at liberty to renew his prayer for bail, if the trial is not concluded within six months.
