2. The petitioner seeks bail in connection with Simultala P.S. Case No. 01 of 2024 registered for the offence punishable under Sections 363 and 366 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is of kidnapping the victim girl.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 20.05.2024.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. From the statement of the victim girl recorded

Patna High Court CR. MISC. No.64100 of 2024(2) dt.01-10-2024 2/2 under Section 161 of the Cr.P.C., it appears that the victim had eloped with the petitioner. The victim is a major and mother of three children.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui in connection with Simultala P.S. Case No. 01 of 2024.
