JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-02-2022 Heard both parties through video conferencing. The petitioner seeks bail in Lakhisarai (Ramgarh Chowk) P.S. Case No. 429 of 2021, registered for the offence punishable under Sections 25(1-b)a, 26 of the Arms Act. As per the prosecution case, raiding party reached near the house of accused Sunil Kumar Sharma (petitioner) to arrest him and two empty cartridges were recovered from road and when raiding party entered into his house, one person trying to flee away after throwing a plastic bag, but he was apprehended by the police. He disclosed his name as Sunil Sharma and from plastic bag one country made pistol and four live cartridges were recovered.

It is submitted on behalf of the petitioner that

No arms and ammunition has has been recovered from possession of this petitioner. Petitioner is suffering from fracture injury and he is in service and posted as Clerk in the Halsi High School, Lakhisarai. Petitioner is in custody since 10.07.2021. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Ramgarh Chowk) P.S.
