JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 29.09.2014 in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

From the bank premises, one motorcycle was recovered from the possession of the petitioner when other motorcycle was recovered from the possession of co-accused Nirbhay Kumar. It is submitted by learned counsel for the petitioner that the recovery is from the public place and not from the possession of the petitioner. A statement has been made in para 3 of the petition that the petitioner is accused in one other case apart from present one.

Considering the nature of accusation and period under custody, let the above named petitioner, be released on bail, on

Patna High Court Cr.Misc. No.1680 of 2015 (2) dt.16-01-2015 2/2 furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Samastipur in connection with Mohiuddinagar P.S. Case No. 210 of 2014.
