The petitioner apprehends his arrest in Gaighat P.S. Case No. 168 of 2021, registered for the offences punishable under Sections 8/20/22 of the Narcotic Drugs and Psychotropic Substances Act.

Prosecution case in brief is that 35 KG of Ganja has been recovered from the house of co-accused Sunil Kumar. It is submitted that name of petitioner transpired during course of investigation on the basis of confessional statement of co-accused. No incriminating article has been recovered from possession of this petitioner. However, counsel for State opposed the prayer for bail and submitted that more than commercial quantity of Ganja has been recovered from the house of co-accused Sunil Kumar

Patna High Court CR. MISC. No.68084 of 2021(3) dt.17-10-2022 2/2 and he disclosed the name of petitioner as one of his associates and petitioner has got one criminal antecedent. Considering the facts aforesaid and nature of accusation, I am not inclined to enlarge the petitioner abovenamed on anticipatory bail. Accordingly, the same is rejected.
