The petitioner seeks bail in Nardiganj P.S. Case No. 80/2013, registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code and 27 of the Arms Act.

The prayer of bail of the petitioner was earlier rejected vide order dated 31.08.2015 passed in Cr. Misc. No. 37999/2015 with a direction to the trial court to conclude the trial within nine months holding the trial on day-to-day basis. There is allegation against the petitioner that he assaulted the deceased with spade on account of which the deceased died.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same

Patna High Court Cr.Misc. No.29804 of 2016 (2) dt.26-11-2016 2/2 is rejected.

The trial court is directed to hold the trial on day-to-day basis and conclude the same within six months from the date of receipt of a copy of this order.

The S.P., Nawada is directed to ensure the attendance of all the prosecution witnesses for their examination in Nardiganj P.S. Case No. 80/2013 so that the trial must be concluded within six months.
