JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2018 The petitioners are apprehending their arrest in connection with Saraiya P.S. Case No. 96 of 2017, registered for offences punishable under Sections 467, 468, 471, 420, 120(B) of the Indian Penal Code.

Allegation against the petitioners is of securing the appointment as teacher on the basis of forged T.E.T. certificates. It has been submitted on behalf of the petitioners that petitioners have falsely been implicate in this case and uptil now the verification report with regard to the certificates of the petitioners has not been received.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let

Patna High Court Cr.Misc. No.48399 of 2018 (2) dt.24-08-2018 2/2 the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on provisional bail till submission of chargesheet on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Muzaffarpur, in connection with Saraiya P.S. Case No. 96 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, as well as subject to the condition that the petitioners shall cooperate in the investigation and shall produce the documents before the Investigating Officer. It is made clear that after submission of charge-sheet, if the allegation against the petitioners is found to be true, the petitioners shall have to surrender before the court below and pray for regular bail, which will be considered on the merit of the case.

With the above observation and direction, this application is disposed of.
