JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-02-2015 Petitioner is languishing in custody since 14.11.2014 in a case registered for the offences punishable under Sections 274, 275, 276, 419, 420, 467, 379 of the I.P.C and Sections 27(b)(ii)/27(c)/27(d), 28/28A of the Drugs and Cosmetic Act and Sections 7(i)(ii),10(A) of the Essential Commodities Act.

On secret information that miscreants are dealing medicines the State Medicines Controller, Patna constituted a raiding team when the house of Uday Kumar was raided from where some alleged spurious drugs were recovered. It is submitted by learned counsel for the petitioner that recovery has been made from the house of Uday Kumar and there is nothing on record to suggest that petitioner was anyway connected with the place of seizure. Patna High Court Cr.Misc. No.4388 of 2015 (2) dt.06-02-2015 2/2 petition that petitioner has no criminal antecedent. It is further submitted that Uday Kumar has been granted bail. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Arrah in connection with Ara-Nawada P.S. Case No. 120 of 2014.
