The petitioner is accused in connection with Imamganj P.S. Case No. 62 of 2004, registered under Section 302, 201/34 of the Indian Penal Code.
The accusation is that marriage of the daughter of the informant was performed with Sahdeo Bhuiyan, who had gone to Delhi for livelihood and in absence of Sahdeo Bhuiyan, the petitioner and others named in the F.I.R. killed the daughter of the informant by causing assault and threw her dead body in the well.
Learned counsel for the petitioner submits that, in fact, daughter of the informant had illicit relationship with co-

No.27953 of 2016 (2) dt.14-07-2016 2/2 villager Govind Bhuiyan, who were caught red handed in objectionable condition and due to that reason daughter of the informant committed suicide by jumping in the well. Further submission is that similarly situated co-accused Badhan Bhuiya has already been granted privilege of bail by a co-ordinate Bench this Court vide order dated 29.01.2016 passed in Criminal Misc. No. 48869 of 2015. The petitioner is in custody since 30.03.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sherghati, Gaya in connection with Imamganj P.S. Case No. 62 of 2004 (G.R. Case No. 771 of 2004.
