The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 379, 401, 414, 411/34 of the Indian Penal Code.
As per prosecution story, the informant raided the house of several accused persons and recovered stolen property from their house and also stolen motorcycles were recovered from co-accused persons from their house.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the basis of conjecture and surmise. Neither the petitioner was arrested nor any incriminating article has been recovered from his conscious

The alleged seized motorcycles recovered from possession of co-accused and the apprehended co-accused persons disclosed the name of the petitioner in their confessional statement. It is further submitted that the petitioner has not been put on T.I.P. The petitioner is languishing in judicial custody since 2.3.2021.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sherghati P.S. Case No. 65 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya.
