JUSTICE HEMANT GUPTA ORAL ORDER 06-10-2016 The present is an application for grant of anticipatory bail under Section 438 of the Code of Criminal Procedure to the petitioner in respect of Shekhpura P.S. Case No. 237 of 2013 dated 29.07.2013 registered for the offences punishable under Sections 419, 420, 406 and 34 of the Indian Penal Code.
The argument of the learned counsel for the petitioner is that he is not named in the F.I.R and that money has not been transferred to his bank account, but transferred to the account of other persons. Therefore, he is entitled for grant of anticipatory bail.
A perusal of the order passed by Additional Sessions Judge, Sheikhpura shows that there are multiple accounts in which the money has been transferred including the details of mobile. It
Patna High Court Cr.Misc. No.30387 of 2016 (2) dt.06-10-2016 2/2 will be question of fact which can possibly be unearthed only if the investigating officer is given custody of the petitioner. In view thereof, I do not find that any case is made out for grant of anticipatory bail. Accordingly, the present application is dismissed.
