The petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 186 of 2013 registered for offence punishable under Section 47(A) of the Excise Act. Mr. Abhay Shankar Singh, learned counsel appearing on behalf of the petitioner with reference to the seizure list submits that whereas the seizure has been made from adjacent to the wine shop itself, the petitioner has no connection therewith rather the petitioner is working in the tempo stand. He further submits that the petitioner has no criminal antecedent.
Having heard learned counsel for the parties and taking note of the allegations, let the petitioner Dilip Kumar in the event of his arrest or surrender before the court below within four weeks
Patna High Court Cr.Misc. No.37030 of 2014 (2) dt.20-02-2015 from today be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 186 of 2013 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
