Petitioner is apprehending his arrest in connection with Siwaipatti P.S.Case No.78 of 2019 , registered for offences punishable under Sections 30 and 30(a) of the Bihar Prohibition and Excise Act, 2016.

Police got information that one Suresh Chaudhary is doing business of liquor and to verify the information, the police was going there, two persons were going and one of them seeing the police succeeded in fleeing away and another was arrested with two ltrs. of liquor . H has also disclosed the name of the person who has succeeded in fleeing away as the petitioner.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.52147 of 2019(2) dt.21-08-2019 2/2 that the apprehended accused person is the father of the petitioner. Petitioner has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Siwaipatti P.S.Case No.78 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that if he is found involved in future in such type of cases, the prosecution is at liberty to move for cancellation of his bail bond.
