The petitioner is apprehending his arrest in connection with Falkaha P.S.Case No.89 of 2019 registered for offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016..

Prosecution story is that the petitioner and his father are engage din liquor trade, house was searched and 13 and odd ltrs. of liquor has been recovered from their house. Submission of the learned counsel for the petitioner is that the recovery is from the house of his father and he has been falsely implicated int his case, having no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.51807 of 2019(2) dt.20-08-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court and if possible to be disposed of on the same day.. With the aforesaid direction, this application is dismissed.
