Petitioner is accused in connection with Teghra P.S. Case No. 218 of 2015 registered under Sections 147, 148, 149, 353, 379, of the I.P.C. and section 27 of the Arms Act. The prosecution case is that one Manohar Kumar @ Ajit Kumar was murdered. Thereafter, the Police on information went on the spot and tried to send the dead body to the Sadar Hospital but on the way, 23 persons named in the F.I.R., including the petitioner and 200-300 unknown blocked the road raising slogans against the administration and obstructed the Police Officials while discharging the official duty. Submission is that petitioner is named in the F.I.R.
Patna High Court Cr.Misc. No.29059 of 2016 (2) dt.20-07-2016 2/2 along with 200-300 unknown persons but no overt act has been alleged against the petitioner. Further submission is that while the petitioner is accused in three cases, as detailed in paragraph no.2 of the supplementary affidavit filed today, but in all cases, he is on bail and in the present case, petitioner is in custody since 07.06.2016.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai in connection with Teghra P.S. Case No.218 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
