JUSTICE SATYAVRAT VERMA ORAL ORDER 01-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 307 and 302/34 of the Indian Penal Code read with Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 19.01.2021, is a person with clean antecedent and charge-sheet has been submitted. The informant alleges that five accused persons surrounded his son and indiscriminate firing was made leading to his death. It is further alleged that the accused escaped on three motorcycle being driven by three other accused persons.

Learned counsel for the petitioner submits that the FIR was registered against unknown and the petitioner has been falsely implicated in the present case. Learned counsel further submits that name of this petitioner transpired in the confessional statement of co-accused Seru Singh and similarly situated co-accused Ajay Kumar has been granted bail by order dated 04.10.2021 passed in Cr. Misc. No. 17529 of 2021. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 19.01.2021, is a person with clean antecedent and chargesheet has been submitted and co-accused has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Buxar (Mufassil) P.S. Case No. 371 of 2020.
