JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 23-09-2015 The petitioner is a PDS dealer. He submits that his licence has been cancelled on 14.11.2012 without service of notice on him.

Learned State counsel submits that it would appear from the impugned order that notice was issued to him on 14.2.2012, 18.4.2012, 8.8.2012 and 11.9.2012. Except responding to letter dated 14.2.2012, the petitioner did not respond to other notices. There is a disputed question of fact whether the petitioner had received the notices or not.

In this view of the matter, the petitioner is relegated to the remedy of appeal. In case, if any, appeal is filed before the Appellate Authority, the delay in filing of the same would be
