The petitioner is in custody in connection with Wazirganj P.S.Case No.158 of 2014 pending in the Court of CJM, Gaya for an offence registered under Sections 147, 148, 149 and 302 of the IPC.

This is the second attempt on behalf of the petitioner for grant of regular bail. The earlier bail application of the petitioner was dismissed vide Cr.Misc.No.41317 of 2015 dated 14.10.2015. The petitioner is in custody since 28.04.2015. The case has not yet been committed to the Court of Sessions. The other accused persons are on bail.

On behalf of the State, it is submitted that there is

Patna High Court Cr.Misc. No.29076 of 2016 (2) dt.20-07-2016 specific allegation against the petitioner for assaulting the deceased with the butt of the pistol on the head. Considering the aforesaid facts and circumstances, I am not inclined to release the petitioner on bail, the same is rejected. Anyhow, the trial Court is directed to take all necessary steps to conclude the trial preferably within a period of one year from the date of receipt/production of a copy of this order.
