====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 03-02-2015 Heard learned counsel for the petitioner, learned A.P.P. for the State as well as learned counsel appearing on behalf of the informant.

The petitioner seeks regular bail in Sivaepatti P.S. Case No. 68 of 2014 for the offence under Sections 302, 201/34 of the Indian Penal Code.

The informant alleged that his son had gone to attend the marriage of his maternal-sister in the house of Brijnandan Rai along with Ragod Rai, Daresh Rai, Ranvir Rai, Ram Bhajan Rai, Suresh Rai and Vijay Rai, but his son did not return. On search, the dead body of the son of the informant was found. Learned counsel for the petitioner submits that there is absolutely no evidence. The name of the petitioner figured in the case on mere suspicion.

Considering the fact that on mere suspicion, the name of the petitioner figured in the case, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate (East), Muzaffarpur in Sivaepatti P.S.
