JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and State The petitioner is accused in Deep Nagar P.S. Case No. 175 of 2017 for the offences under Sections 414/34 of the Indian Penal Code.

From the seizure list it appears that the alleged motorcycle suspected to be stolen was seized near the house of one Bijay Kumar and nothing was recovered from the conscious possession of the petitioner as per the statement of counsel for the petitioner.

There is statement on affidavit in para-3 of the petition that the petitioner has no criminal antecedent. Having regard to the fact that nothing was recovered

Patna High Court Cr.Misc. No.37906 of 2017 (2) dt.19-08-2017 2/2 from the conscious possession of the petitioner and the alleged stolen motorcycle was recovered near the house of one Bijay Kumar, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda or the successor Court in connection with Deep Nagar P.S. Case No. 175 of 2017, subject to the condition that the petitioner will extend full cooperation in the conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
