Petitioner apprehends his arrest in connection with Andhramath P.S.Case No. 98 of 2016 registered for the offences punishable under Sections 406, 409 and 420/34 of the Indian Penal Code.

Allegation as per FIR is misappropriation of money which has been allotted for construction of school building and petitioner is said to be In-charge Headmistress of the school. Submission of learned counsel for the petitioner is that petitioner was only an Assistant Teacher of the school and later on Headmaster had resigned and petitioner had taken the charge and there is no allegation against the petitioner of misappropriation of money.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of her arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Jhanjharpur, Madhubani, in connection with Andhramath P.S.Case No. 98 of 2016, corresponding to CRI (GR) No. 1809 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
