JUSTICE GOPAL PRASAD ORAL ORDER 04-03-2015 The report called for vide order dated 19.1.2015 from the learned court below reveals that altogether seven witnesses have been examined so far and though several steps to procure the attendance of the Investigating Officer and the Medical Officer had already been taken but till date they have not been produced.
Learned counsel for the petitioner submits that the petitioner is in jail since 9th of April, 2011, i.e., more than three years.
Hence, the trial court is directed to take coercive steps against the official witnesses through the Superintendent of Police, Patna, fixing a date and Superintendent of Police, Patna, is directed to ensure the attendance of the official witnesses, the
Patna High Court Cr.Misc. No.1934 of 2015 (3) dt.04-03-2015 2/2 Medical Officer and the Investigating Officer on the date fixed and ensure the attendance of the witnesses on the date fixed and the trial court is directed to conclude the trial within six months from today.
Let a copy of this order be sent to the trial court as well as the S.P.,Patna, for immediate compliance. With the aforesaid observation, this bail application is disposed of.
