JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 15.07.2014 in a case registered for the offences punishable under Sections 302, 201 and 379 of the Indian Penal Code.

It is alleged that on 09.07.2014 at 5.30 PM the husband of the informant went outside but he did not return. On 10.07.2014 at 9.30 AM, police informed the informant that her husband met with an accident hence advised to contact Dhanarua Police Station, when the informant proceeded to the police station but on the way the dead body of the husband of the informant was found in a mud. The FIR was lodged against unknown suspecting to a case of murder. The postmortem report reflects three injuries. During investigation, it was gathered that the victim has tiff with his brother-in-law Subhash Kumar since he has illicit relationship with

Patna High Court Cr.Misc. No.2646 of 2015 (2) dt.22-01-2015 2/2 a widow which was objected by the victim, subsequently, Subhash Kumar, Ramji Yadav and Awadhesh Bind killed the victim. It is submitted by learned counsel for the petitioner that there is no eye-witness to the occurrence and accusation has been levelled only on suspicion. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Mashauri, Patna in connection with Dhanarua P.S.
