JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.
Petitioner is in jail custody since 22.09.2015 and earlier his prayer for bail was rejected by this court taking note of this fact that victim stated the role of the petitioner in the present crime under her statement recorded under Section 164 of the Cr.P.C.
Again, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 275 of 2016 arising out of Majorganj P.S. Case No. 52
Patna High Court Cr.Misc. No.42108 of 2017 (3) dt.20-09-2017 2/2 of 2015 pending in the court of Additional Sessions Judge-I, Sitamarhi stands rejected.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably within four months from the date of receipt/production of copy of this order, failing which the petitioner may renew his prayer for bail before the learned trial court itself.
