JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 22/09/2014 in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.
Accusation is of snatching the mobile of the informant. The petitioners was apprehended on the spot and mobile of the informant was recovered.
It is submitted by the learned counsel for the petitioner that the alleged mobile was not recovered from conscious possession of the petitioner.
Learned counsel for the State has submitted that the petitioner has criminal antecedent.
Considering the period under custody, let the above named
Patna High Court Cr.Misc. No.2619 of 2015 (2) dt.21-01-2015 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Gaya in Gaya Rail P.S.Case No. 95 of 2014.
The court below will be liberty to cancel the bail bonds of the petitioners if he gets substantially involved in some serious nature of offence or defaults for two consecutive occasions. (Dinesh Kumar Singh, J) singh/- U T
