The petitioner seeks regular bail in connection with S.T.No.747 of 2016 arising out of Bihpur (Jhandopur) P.S.Cae No.181 of 2014 registered for offences punishable under Sections 302/34 of the Indian Penal Code.

The name of the petitioner has transpired on confession of the co-accused, who has already been granted bail by this Court vide order dated 8.11.2016 passed in Cr. Misc. No.35194 of 2016 and the other co-accused persons having similar allegation have already been granted bail, vide order dated 20.8.2016 passed in Cr. Misc. No.35888 of 2016, order dated 21.11.2016 passed in Cr. Misc. No.32478 of 2016 and order dated 13.5.2016 passed in Cr. Misc. No.14408 of 2016. The petitioner is in custody since 30.7.2017.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional District and Sessions Judge, Naugachia in connection with S.T.No.747 of 2016 arising out of Bihpur (Jhandapur) P.S.Case No.181 of 2014 dated 9.6.2014. With following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.

(iv) Further condition that till conclusion of the trial of this case, he will make his attendance before the concerned Police Station of the area in the first week of every month, otherwise, his bail bond shall be cancelled.
