JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-387/34 of the Indian Penal Code and 27 of the Arms Act as also under Sections-3/4 of Explosive Substances Act. The name of petitioner came in this case in confessional statement of co-accused.

It appears that except the aforesaid confessional statement as well as some criminal antecedent of the petitioner, there is nothing against him. Moreover, having more or less similar allegation, one co-accused namely, Ramprit Rai in whose confessional statement, the name of petitioner came in this case,

Patna High Court Cr.Misc. No.37017 of 2016 (2) dt.05-09-2016 2/2 has already been granted privilege of bail by this court. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chhauradano P.S. Case No. 193 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari.
