JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-489(a)/489(B) & 489 (C) of the Indian Penal Code. Petitioner is not named in the first information report and the impugned order goes to show that the name of petitioner came in confessional statement of co-accused Arshad, who was caught with counterfeit notes. The said co-accused, Arshad has already been granted privilege of bail by a coordinate bench of this court.

Submission on behalf of petitioner is that the petitioner was arrested from his house but nothing was recovered either from conscious possession or from house of the petitioner.

Patna High Court Cr.Misc. No.37222 of 2016 (2) dt.06-09-2016 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Araria (R.S.) P.S. Case No. 350 of 2015 to the satisfaction of Chief Judicial Magistrate, Araria.
