Petitioner is languishing in custody since 02.06.2014 in a case registered for the offences punishable under Sections 414, 420/34 of the Indian Penal Code, 17 of the C.L.A. Act and Section 25(1-b)a, 26, 35 of the Arms Act. On information to the police that the some persons are taking fuel in the vehicle without payment from petroleum dealership, raid was laid when four person tried to flee away from a Scorpio vehicle, while two of them petitioner and Janardan Singh were apprehended and two managed to escape. From the vehicle in question one country made rifle, empty magazine of a pistol, a display board and two number plates were recovered.
Patna High Court Cr.Misc. No.4090 of 2015 (2) dt.30-01-2015 It is submitted by the learned counsel for the petitioner that the seizure of arms cannot be treated from the possession of the petitioner as the petitioner was not apprehended from the vehicle in question and for the same incident one other case being Bikarmganj P.S. Case No. 81 of 2014 was registered.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Bikramganj, Rohtas in connection with Bikramganj P.S.
