The petitioner seeks bail in Narkatiyaganj Rail P.S. Case No. 21 of 2016 registered under Section 364(a) of the Indian Penal Code.
The informant lodged the case against unknown for kidnapping of the nephew of the informant. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Nothing has been recovered from the possession of the petitioner. One Pintu was apprehended from whose possession the mobile phone from which ransom was demanded was recovered. Pintu disclosed that the petitioner sold the mobile to him on a consideration of Rs. 2700/-. It is submitted that save and except the confession of Pintu, there is no other material against the
Patna High Court Cr.Misc. No.39472 of 2016 (4) dt.05-12-2016 2/2 petitioner. Even the SIM was not standing in the name of the petitioner. Learned A.P.P. also submitted that except the confessional statement of Pintu, there is no other material against the petitioner.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Bettiah, West Champaran in Narkatiyaganj Rail P.S. Case No. 21 of 2016.
