JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-337, 338, 307, 120(B) & other minor sections of the Indian Penal Code.

The accusation against petitioners is that they along with several other persons forcibly, started constructing the house on a disputed land, which is subject matter of Partition Suit No. 372 of 2013, in which, order regarding status quo had been passed. Furthermore, it is alleged that when police party reached there, petitioners and their supporters became furious and started pelting

Patna High Court Cr.Misc. No.37378 of 2016 (2) dt.08-09-2016 2/2 stones and also, torn the dress of police officials. Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that petitioners are in jail custody since 14-052016 without having any criminal antecedent, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Raj Nagar P.S. Case No. 103 of 2016 to the satisfaction of Sri Vikash Jha, learned Judicial Magistrate-Ist Class, Madhubani.
