The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 411, 413, 414, 34 of the Indian Penal Code.

As per prosecution case, the informant got secret information about illegally sale and purchase of stolen motorcycles, thereafter, the informant with police party reached at the place of occurrence and apprehended co-accused persons, who disclosed that this petitioner is also their associate. It is further alleged that some stolen motorcycles were seized from the place of occurrence.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. Neither the

No.56612 of 2022(3) dt.16-02-2023 2/2 petitioner was arrested on spot nor any incriminating article has been recovered from this conscious possession which shows his involvement in this case. The name of the petitioner came into light on the basis of confessional statement of co-accused namely, Ranjan Kumar who is already getting the privilege of bail granted by coordinate Bench of this Court vide order dated 16.8.2022 in Cr. Misc. No. 29352 of 2022. It is further submitted that the petitioner is languishing in judicial custody since 30.3.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bettiah (Town) P.S. Case No. 57 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran.
