Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Para-16 of the case diary reveals that petitioner and victim appeared suo motu before the Investigating Officer and after that petitioner was taken into custody whereas victim was detained in police station along with her mother. The victim was medically examined and after that her statement under Section 164 Cr.P.C. was recorded. The statement of victim recorded under Section 164 Cr.P.C. is not consistent and she has made contradictory statement.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.3820 of 2015 (3) dt.21-04-2015 2 / 2 as well as submissions of the parties, let petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S.
