The petitioners seek bail in a case instituted for the offences under Sections 147, 323, 447, 379, 504 and 427 of the Indian Penal Code.

Prosecution case, in short, is that the accused persons variously armed snatched Rs. 3000/- from the pocket of the informant.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 29.6.2019 and have got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case for bailable offence and the petitioners were granted bail by the Court below. This is a case for misuse of bail. The petitioners had gone out of the State for his bread

Patna High Court CR. MISC. No.52861 of 2019(2) dt.26-08-2019 2/2 and butter. Proper pairvi was not made in their absence. The petitioners undertake to cooperate during the trial. On behalf of the State, it is submitted that the petitioners are named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Supaul in connection with Marauna P.S. Case No. 81 of 1998, G.R. No. 1079/98 with a condition that petitioners will appear on each and every date fixed in the trial.

In case of default in their appearance on two consecutive dates, the Trial Court will take necessary steps in accordance with law to secure their arrest/appearance. The Trial Court is further directed to take all necessary steps to conclude the trial at the earliest preferably within six months from the date of receipt/production of a copy of this order since the prosecution is of the year 1998.
