JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 323, 302/34 of the Indian Penal Code.

As per the prosecution case, all the FIR named accused persons, including this petitioner, brutally assaulted the brother of informant as a result of which he died. Learned counsel appearing for the petitioner submits that petitioner is father-in-law of the deceased. There is no eye witness of the occurrence and petitioner has been made accused only on suspicion. As a matter of fact marriage of son of petitioner was to be solemnized on 09.06.2021 and wife of deceased was also present at the house of this petitioner and the deceased, who was a drunkard, consumed excess liquor and fell

No.65793 of 2021(3) dt.18-04-2022 2/2 down on the road and died and taking advantage of situation, the informant has falsely implicated the petitioner with his whole family members. Petitioner claims clean antecedent and is in custody since 18.09.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Siwan in connection with Nautan PS case No.117/2021.
