Petitioner apprehends his arrest in connection with Alauli P.S.Case No. 76 of 2016 registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code. Allegation against the petitioner is of kidnapping of minor daughter of informant.

Submission of learned counsel for the petitioner is that the girl was recovered and her statement recorded under Sectiion 164 Cr.P.C disclosed that her age was 19 years and she had gone with the petitioner to Bangalore on her own sweet will and married the petitioner and further medical report shows her age as 17-19 years.

No.47463 of 2018 (2) dt.14-08-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Alauli P.S.Case No. 76 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
