The petitioner seeks bail in connection with Fulkaha P.S. Case No. 103 of 2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.10.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that allegation is of recovery of 780 litres of liquor from a Sumo vehicle.

Learned counsel for the petitioner submits that the

No.65619 of 2021(2) dt.11-02-2022 2/2 petitioner has been falsely implicated in the case, he was not arrested from the spot nor the vehicle belongs to him though has been implicated showing that he is the owner of the vehicle. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 08.10.2021, charge-sheet has been submitted in the case and the petitioner was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Araria in connection with Fulkaha P.S.
