This is an application for bail in connection with Parsa P.S. Case No. 54 of 2017 registered for the offences punishable under Sections 147, 148, 341, 324, 325, 307 and 504 of the Indian Penal Code.
Allegation against the accused persons, including the petitioner is of assaulting the informant and others and there is specific allegation against the petitioner of assaulting one Mahtab Alam by knife in his abdomen.
Submission of learned counsel for the petitioner is that there is case and counter case between the parties and the case of the petitioner is earlier to the present case and petitioner's side also received injuries. Further submission is that he is in custody
Patna High Court Cr.Misc. No.40909 of 2017 (2) dt.06-09-2017 2/2 since 27.4.2017.
Heard learned APP also, who has opposed the prayer for bail stating that the injured has received injuries on his abdomen by knife blow of the petitioner.
Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, he may renew his prayer for bail after framing of charge in this case.
