2. The petitioner seeks regular bail in connection with Madhwapur P.S. Case No. 62 of 2023, (G. R. No. 1007/2023) registered for the offence punishable under Sections 272, 273, 414, 34 of the Indian Penal Code and under Section 25(1-b)a/ 26/35 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution, 107.77 litres of illicit liquor, one country made pistol and one live cartridge were recovered from the motorcycle of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody

5. Learned APP has vehemently opposed the prayer for bail.
6. Considering the aforesaid fact, this application is allowed.
7. Let the petitioner, above named, be released on bail after completing six months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge cum Special Judge, Excise Act, Madhubani, in connection with Madhwapur P.S. Case No. 62 of 2023, (G.R. No. 1007/2023).
8. This is also subject to the condition that the petitioner shall mark his presence in Charaut Police Station, District- Sitamarhi on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below. (Sandeep Kumar, J) Ranjeet/- U T
