The petitioner seeks regular bail in connection with Dhanarua P.S. Case No. 84 of 2017, registered for the offence punishable under Sections 341, 323, 324, 307, 34 of the I.P.C. The case of the prosecution is that the petitioner along with other accused persons had surrounded the son of the informant and assaulted him resulting in grievous injuries to him due to which he became unconscious.
Learned counsel for the petitioner submits that injury report annexed as Annexure-2 to this petition will show that the injuries are simple in nature. He further submits that the allegation against the petitioner is general in nature and no allegation of any specific overt act has been leveled against the petitioner. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi in connection with Dhanarua P.S. Case No. 84 of 2017.
