JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Muffasil P.S.Case No. 07 of 2018, registered for offences punishable under Sections 147, 148, 149, 307, 427 and 341 of the Indian Penal Code and Section 27 of Arms Act. As per F.I.R., allegation against the petitioners, who are named in the F.I.R., are that the petitioners along with other coaccused persons came to the house of the informant and on the order of one Munna Yadav, they started firing and thereafter fled away.

Submission of the learned counsel for the petitioners is that they have been falsely implicated in this case and no any

No.49403 of 2018 (2) dt.28-08-2018 2/2 specific allegation of overt act against these petitioners and other co-accused Munna Yadav, who is an order giver, has been granted privilege of anticipatory bail by this Court vide order dated 05.07.2018 passed in Cr.Misc. No. 34937 of 2018. It is also submitted that the petitioners have no criminal antecedent. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named on surrender or arrest within six weeks be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Muffasil P.S.Case No. 07 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
