JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

I find that it is a case of misuse of privilege of bail and it is stated that bail bond of the petitioner was cancelled on 31.07.1998 and after that he could be remanded in this case on 13.05.2008 and since then he is languishing in jail custody.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Gaya in connection with Sessions Trial No. 137 of 2014/279 of 2001 arising out of Rampur P.S. Case No. 46 of 1995.
