JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and is languishing in jail custody since 17.2.2016 in a case registered under Section 304B/34 of the Indian Penal Code. No doubt, there is allegation of illegal demand as well as torture and deceased died within one year of her marriage but the fardbeyan of the informant goes to show that it was petitioner, who had given information to the informant regarding the ill health of the deceased and having got the information, informant came at the house of the petitioner and found the deceased dead. The postmortem report goes to show that no external or internal injury was found on the person of the deceased and doctor kept the

Patna High Court Cr.Misc. No.36190 of 2016 (5) dt.22-10-2016 2/2 viscera reserved for examination. The doctor could not give opinion for cause of death of the deceased. In course of investigation, except informant and his other family members, no one has stated anything against the petitioner. The investigation against the petitioner has already been completed. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J.-V, Siwan in connection with Sessions Trial No.238 of 2016 arising out of Nautan P.S.
