The petitioner seeks regular bail in Bhagwanpur P.S. Case No. 4 of 2008 registered under Sections 120(B), 406, 409, 420, 467 and 468 of the Indian Penal Code.

Ashok Kumar, the informant, alleged that Vijay Kumar, accused no. 1, fraudulently got his appointment by submitting a forged mark-sheet. The informant gave application under R.T.I. Act and when it transpired that Vijay Kumar submitted a mark-sheet showing that he got 633 marks out of 900 marks, his mark-sheet was sent for verification. It was found that Vijay Kumar only got 609 marks out of 900 marks. Thereafter, the petitioner, being the Panchayat Sachiv, received the resignation letter of Vijay Kumar. The petitioner is in jail since 19.05.2014. Learned A.P.P., however, has opposed the prayer for

From perusal of the records, it appears that the petitioner was the Panchayat Sachiv. The said mark-sheet was produced by Vijay Kumar, which was later on found to be forged. The petitioner only accepted the resignation letter of Vijay Kumar. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is in jail since 19.05.2014, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar Srivastav No. 2, Judicial Magistrate 1st Class, Siwan in Bhagwanpur P.S. Case No. 4 of 2008.
